FDA Regulations: Cosmetics

What role does the FDA play in regulating cosmetics?
The Food and Drug Administration (FDA) governs the labeling of cosmetics. Representations about makeup products on websites, on social media sites and in promotional materials must be compliant with FDA rules and regulations.

Why can’t I claim therapeutic or curative properties for a cosmetic product?
Drugs are closely regulated by the FDA and require advance FDA approval prior to marketing and distribution, while cosmetics are largely unregulated, are not registered with the FDA, and have fewer restrictions. A product’s intended use or claimed benefit is generally the determining factor in classifying it as a cosmetic or a drug under the FDA rules. For this reason, any claims of drug-like benefits in cosmetic products — even if true — create additional legal obligations and requirements. As an Independent Contractor, you are responsible for inappropriate drug claims if the FDA reviews your website and/or social media account and discovers violations. To avoid any legal pitfalls and compliance issues, we would encourage you to closely follow the rules and use the Younique website and promotional materials as a guideline when making claims about our products.

How do I know if I am making an improper claim or representation?
When making a statement about a product, please consider the following questions:

  • ​Is it truthful? Consult with official Younique literature to make that determination.
  • ​Is it misleading? Representations should not be deceptive or imply things that are unproven.
  • ​Can the representations be supported and substantiated? Personal experience is insufficient support for a general product representation.
  • ​Is it objective or subjective? Subjective is safer — can say “I love how this product makes my skin look and feel” but can’t say “This product is the best on the market for skincare.”
  • ​Is it appearance-based or does it imply drug-like benefits? Statement needs to be appearance-based and not promote use for medical-type conditions.

What kinds of claims can I make?
Appearance-based claims that are superficial in nature are fine. Stick to words and phrases that connote changes to physical appearance rather than any alterations to the physical body or structure.  Specifically, claims that relate to cleansing, beautifying, promoting attractiveness or even altering the outward appearance are fine. “Younger-looking” or “covers” would be acceptable words while “younger” or “removes” or “prevents” would suggest a physiological change and would be characteristic of a drug.

What kinds of claims are inappropriate?
Any claim that expressly or impliedly suggests that a product can cure, mitigate, treat or prevent a disease or the structure or any function of the body would be inappropriate. Such claims would include but are not limited to claims such as wrinkle prevention or cures, eczema treatments, cell regeneration, and sunscreen.

What if I just share my personal experience with a product on my own web page or social media posting?
All claims must comply with these requirements, including web pages and social media postings. While you may clearly state your personal opinion about a product, any posting that generally attributes a drug-like benefit to a Younique product is potentially in violation of the FDA rules and should be avoided to protect your business from an FDA compliance action. Again, we encourage you to use Younique’s marketing and website materials as a guideline when making representations about company products.

Self-Serve Portal Instructions

The self-serve option in your Back Office allows you to initiate a return or exchange request from your order’s receipt page.

  • For Presenters: To initiate a request, go to “Customer Connect” in your Back Office and select the “Orders” tab.
  • For customers: To initiate a request, go to “My Tools” and select “My Orders.”

1. Click on the Order ID for the order that contains the products you would like to return or exchange. On the order’s receipt page, scroll to the bottom of the page and select the “Start a Return” button.

2. Select the product you would like to return or exchange. To ensure that your request is processed as quickly as possible, we recommended submitting returns or exchanges separately from quality concern submissions.

3. Fill out the drop-downs for each item you selected.

Note: If you select the “Damaged Packaging or Hardware, Quality Concern, or Other” option, you will be prompted to include a photo of the product.

4. You will have the option to review your request before submitting it.

5. Returns and Exchanges: Once you have selected “Submit” the resolution chosen will be issued to your account. If you choose to return the product back to us, you will be provided with a RMA number and return label. Please keep in mind that the return label is not prepaid.

There are certain requests that cannot be completed through the self-serve portal. For these situations, please contact Customer Care for further assistance.

Customer Care Returns

To initiate a return or exchange with Customer Care, please contact us with your Order ID. Customer Care will be able to provide you with your order-specific return instructions and your unique RMA number, which is required to process any return with Younique.

Do I need to pay return shipping?
Yes. Under our Love It Guarantee, we require the customer to pay any return shipping costs for a return or exchange. 

When will I receive my refund?
Once we receive your package in our Return Facility, please allow up to 7 business days to be contacted regarding your refund. 

Why does the refund option only allow me to choose Y-CASH, even when I’m within the 14 day return time frame for my order?
To allow your order time to process, ship, and deliver, the refund to card option will not show in the self-serve portal until 8 days after your order has been placed. On day 8 the “Refund” option will become available. If you need any assistance completing your RMA for a refund, please reach out to Customer Care who can assist you further.

Can I return my product in person to the Distribution Center or the Corporate Offices?
Unfortunately, no. We do not have the ability to accept packages delivered to our offices in person.

Cancel My Order

As stated in our Younique Love It Guarantee, you may cancel your Order within three hours of it being placed. If you checked out by logging into your social media account, you can cancel your Order by logging into your account, selecting ‘My Account’, ‘My Orders’, and choosing the order you wish to cancel.

Waiting for Refund

Younique does not store your credit card information. All transactions are processed through our merchant providers, Braintree and Worldpay. Once Younique processes your refund, it can take anywhere from a few minutes and up to two weeks for your Financial Institution to display that credit on your statement.

If you have any questions regarding your credit card transaction, when it will be refunded, or when a “pending” charge will drop off, please contact your credit card company. For security reasons, Younique is not able to make any calls on your behalf to your financial institution.

Change Items in Order

We do everything in our power to ensure your order processes with our Shipping Department as quickly as possible. Because of this, we are unfortunately unable to make changes to your order’s content once it has been successfully placed. Within our three hour cancellation window you do have the option to cancel your order, after which you could place another order with the correct items.

If you checked out as a guest (without attaching your Facebook account), please contact Support if you want to cancel your order. We would be happy to assist you!

What is YOU·OLOGY skin care?  
The YOU·OLOGY skin care line is a line of skin care products that allow you to discover solutions to all your skin concerns. The line has four base products—cleanser, serum, day moisturizer, and night cream—that come with your choice of boosters to personalize your skin care as well as an array of makeup removers, toners, oils, and masks.  
Some products in the YOU·OLOGY skin care line are those you knew and loved as part of the YOUNIQUE ROYALTY line, and others are completely brand new to Younique. 

When can I buy YOU·OLOGY skin care? 
YOU·OLOGY skin care launches to Younique Presenters only January 15, 2019, at 6 a.m. PST. YOU·OLOGY skin care will launch to all customers and Younique Presenters February 1, 2019, at 6 a.m. PST.  

I’m a Younique Presenter. How many of each product can I buy during the Younique Presenter-only prelaunch?  
There is no limit to how many of each product you can buy. Please note, however, that there is a limit of one YOU·OLOGY booster bundle per Younique Presenter. To find out more about the YOU·OLOGY booster bundle, go here.  

Why is the YOUNIQUE ROYALTY detoxifying mask now called the YOU·OLOGY perfecting mask?  
As part of the YOU·OLOGY skin care launch, we carefully considered the names of each product transitioning from the YOUNIQUE ROYALTY line into the YOU·OLOGY line, and we felt that this particular product needed a slight name change that was fitting for the product.   

How did the YOU·OLOGY cleansing cloths change?   
The YOU·OLOGY cleansing cloths have been reformulated to create a better product. They are reformulated with a new fragrance and less oily texture.  

Do I need to buy all four bases at the same time?  
You do not need to buy all four bases at once, but we recommend it! Using all four bases—including cleanser, serum, day moisturizer, and night cream—as the foundation of your skin care regimen allows you to choose 12 boosters (three for each base), which will help you diversify and expand the results you can get.  

How many boosters come with each base?  
Each YOU·OLOGY base, including the cleanser, serum, day moisturizer, and night cream, comes with three boosters of your choice. Each base container has space for three boosters, and selecting three boosters allows you to maximize the results you can see.  

Can I get more than three boosters with my base?  
Each base comes with your choice of three boosters, and the bases are filled in order to accommodate for the addition of three boosters.  

Can I buy boosters separately?  
Each booster is created to be used with one base. They are not available for individual purchase and should not be used except in the base for which they were created.   

Can I have more than one of the same booster in the same base?  
At present, you must choose 3 distinct boosters per base. We want you to achieve as many results as you can in your regimen.    

Can I use boosters that were made for one base in a different base?   
Each booster is created to be used with one base. They should not be used except in the base they were created for.  

Where can I see the ingredients for each product?  
A full list of a product’s ingredients can be seen on that product’s purchasing page and on its fact sheet.  

Are the products made for all skin types?  
Yes—each product is clinically tested to be safe for all skin types.   

Does the day moisturizer have SPF?    
No, neither the day moisturizer base nor the accompanying boosters currently contain SPF.
